agirlANNAPOLIS, Md. –  Maryland’s  already-strong gun laws will become among the strictest in the nation with a  measure passed by the General Assembly Thursday, sending the bill to the  Democratic governor who proposed the legislation in the aftermath of December’s  massacre at a Newtown, Conn., elementary school.

The state Senate voted 28-19 for final passage, agreeing to a number of  changes the House of Delegates approved Wednesday.

The measure would require people who buy a handgun to submit fingerprints to  state police, bans 45 types of assault weapons, and limits gun magazines to 10  bullets. It also addresses firearms access for the mentally ill.

“Together, with a strong coalition of advocates, and the people of Maryland  who overwhelmingly support policies to reduce gun violence, we’ve chosen to take  action by advancing strategies that work to save lives,” Gov. Martin O’Malley  said in a statement after the vote.

Maryland will become the first state in nearly 20 years to require potential  handgun buyers to submit fingerprints to state police. Only five other states  have a similar requirement: Connecticut, Hawaii, Massachusetts, New York and New  Jersey.

Gun control advocates say the fingerprinting requirement will help keep guns  away from criminals, because it will make people reluctant to buy firearms for  those who are not allowed to have them. Opponents say the bill erodes Second  Amendment rights and ultimately penalizes law-abiding citizens without focusing  on lawbreakers.

Although the measure bans 45 types of assault weapons, people who own them  now will be able to keep them. People who order the weapons before Oct. 1, when  the law would take effect, also would be able to keep them.

People who have been involuntarily committed to a mental health facility  won’t be allowed to have a gun.

Critics noted that Maryland already has strong laws, including universal  background checks and a seven-day waiting period to buy a gun. The state doesn’t  even have a loophole allowing for private sales at gun shows without the same  background check that licensed dealers are required to obtain, said Sen. Allan  Kittleman, R-Howard.

UN adopts pact to regulate multibillion-dollar global arms trade
The U.N. General Assembly has overwhelmingly approved the first U.N. treaty  regulating the multibillion-dollar international arms trade.

The resolution adopting the landmark treaty was approved by a vote of 154 to  3 with 23 abstentions.

The 193-member world body voted after Iran, North Korea and Syria blocked its  adoption by consensus at a negotiating conference last Thursday. The three  countries voted “no” on the resolution.

The National Rifle Association has portrayed the draft treaty as a threat to  gun ownership rights enshrined in the U.S. Constitution and has lobbied to  defeat the proposal at the U.N. The NRA last week praised the Senate’s passage  of an amendment to the Democratic budget proposal that would prevent the U.S.  from entering into the treaty.

2nd Amendment Rights Under Fire – U.N. Treaty & Firearm Registration – Gun Control

Aaa UnUNITED NATIONS –  Supporters of a U.N.  treaty designed to regulate the multibillion-dollar global arms trade were  optimistic that a final draft circulated a day before Thursday’s deadline will  reach consensus.

Negotiators reconvened last week in a final attempt to reach a deal on the  Arms Trade Treaty, which would require all countries to establish national  regulations to control the transfer of conventional arms and to regulate arms  brokers.

U.N. diplomats, speaking on condition of anonymity because negotiations have  been private, said Wednesday the United States was virtually certain to go along  with the latest text.

Hopes of reaching agreement on what would be a landmark treaty were dashed  last July when the U.S. said it needed more time to consider the proposed accord  — a move quickly backed by Russia and China. In December, the U.N. General  Assembly decided to hold a final conference and set Thursday as the deadline for  reaching agreement.

“We need a treaty,” China’s U.N. Ambassador Li Baodong told The Associated  Press. “We hope for consensus.”

Questions remain on whether Iran, Egypt, India and several other countries  that had serious concerns about the text would go along with the draft, which  requires agreement of all 193 U.N. member states for adoption.

There has never been an international treaty regulating the estimated $60  billion global arms trade. For more than a decade, activists and some  governments have been pushing for international rules to try to keep illicit  weapons out of the hands of terrorists, insurgent fighters and organized  crime.

“It’s important for each and every country in the world that we have a  regulation of the international arms trade,” Germany’s U.N. Ambassador Peter  Wittig told the AP. “There are still some divergencies of views, but I trust we  can overcome them.”

The draft treaty does not control the domestic use of weapons in any country,  but it would require all countries to establish national regulations to control  the transfer of conventional arms, parts and components and to regulate arms  brokers. It would prohibit states that ratify the treaty from transferring  conventional weapons if they would violate arms embargoes or if they would  promote acts of genocide, crimes against humanity or war crimes.

The final draft makes this human rights provision even stronger, adding that  the export of conventional arms should be prohibited if they could be used in  the commission of attacks on civilians or civilian buildings such as schools and  hospitals.

The National Rifle Association has portrayed the draft treaty as a threat to  gun ownership rights enshrined in the U.S. Constitution and has lobbied to  defeat the proposal at the U.N.

The NRA last week praised the Senate’s passage of an amendment to the  Democratic budget proposal that would prevent the U.S. from entering into the  treaty.

The measure, introduced by Sen. James Inhofe, R-Okla., passed on a 53-46  vote.

“Thanks to the efforts of Senator Inhofe, we are one step closer to ensuring  the U.N. will not trample on the freedoms our founding fathers guaranteed to  us,” Chris W. Cox, executive director of NRA’s Institute for Legislative Action,  said in a statement released following the vote.

Ammunition has been a key issue, with some countries pressing for the same  controls on ammunition sales as arms, but the U.S. and others opposed such tough  restrictions. The draft calls for each country that ratifies the treaty to  establish regulations for the export of ammunition “fired, launched or  delivered” by the weapons covered by the convention.

The Control Arms coalition, which represents about 100 organizations  worldwide campaigning for a strong treaty, and diplomats from countries that  support them, said this wouldn’t cover hand grenades and mines.

India and other countries had insisted that the treaty have an opt-out for  government arms transfers under defense cooperation agreements. The new text  appears to keep that loophole, stating that implementation of the treaty “shall  not prejudice obligations” under defense cooperation agreements by countries  that ratify the treaty.

“Making this treaty was like making a sausage: Everyone has added an  ingredient,” said Ted Bromund, a senior research fellow at The Heritage  Foundation, a conservative think tank.

“Unfortunately, that has produced a document that leans much too far towards  satisfying the concerns of the Arab Group and Mexico. The former view it as a  rebellion prevention plan, while the latter wants a text that edges towards its  view that the domestic firearms market in the U.S. should be subject to treaty  regulation,” he said.

But Daryl Kimball, executive director of the independent Washington-based  Arms Control Association, said, “The emerging treaty represents an important  first step in dealing with the unregulated and illicit global trade in  conventional weapons and ammunition, which fuels wars and human rights abuses  worldwide.”

He said the text could have been stronger and more comprehensive, but it can  still make an important difference.

“The new treaty says to every United Nations member that you cannot simply  ‘export and forget,’” Kimball said.

In considering whether to authorize the export of arms, the draft says a  country must evaluate whether the weapon would be used to violate international  human rights or humanitarian laws or be used by terrorists or organized crime.  The final draft would allow countries to determine whether the weapons transfer  would contribute to or undermine peace and security.

Anna Macdonald, Oxfam’s head of arms control, said the scope of the weapons  covered in the latest draft is still too narrow.

“We need a treaty that covers all conventional weapons, not just some of  them,” she said. “We need a treaty that will make a difference to the lives of  the people living in Congo, Mali, Syria and elsewhere who suffer each day from  the impacts of armed violence.”

12 Things That Just Happened That Show The Next Wave Of The Economic Collapse Is Almost HereAre we running out of time?  For the last several years, we have been living in a false bubble of hope that has been fueled by massive amounts of debt and bailout money.  This illusion of economic stability has convinced most people that the great economic crisis of 2008 was just an “aberration” and that now things are back to normal.  Unfortunately, that is not the case at all.  The truth is that the financial crash of 2008 was just the first wave of our economic troubles.  We have not even come close to recovering from that wave, and the next wave of the economic collapse is rapidly approaching.  Our economy is like a giant sand castle that has been built on a foundation of debt and toilet paper currency.  As each wave of the crisis hits us, the solutions that our leaders will present to us will involve even more debt and even more money printing.  And each time, those “solutions” will only make our problems even worse.  Right now, events are unfolding in Europe and in the United States that are pushing us toward the next major crisis moment.  I sincerely hope that we have some more time before the next crisis overwhelms us, but as you will see, time is rapidly running out.

#1 According to TrimTab’s CEO Charles Biderman, corporate insider purchases of stock have hit an all-time low, and the ratio of corporate insider selling to corporate insider buying has now reached an astounding 50 to 1….

While retail is being told to buy-buy-buy, Biderman exclaims that “insiders at U.S. companies have bought the least amount of shares in any one month,” and that the ratio of insider selling to buying is now 50-to-1 – a monthly record.

#2 On Friday we learned that personal income in the United States experienced its largest one month decline in 20 years

Personal income decreased by $505.5 billion in January, or 3.6%, compared to December (on a seasonally adjusted and annualized basis). That’s the most dramatic decline since January 1993, according to the Commerce Department.

#3 In a stunning move, Michigan Governor Rick Snyder says that he will appoint an emergency financial manager to take care of Detroit’s financial affairs…

Snyder, 54, took a step he avoided a year ago, empowering an emergency financial manager who can sweep aside union contracts, sell municipal assets, restructure services and reorder finances. He announced the move yesterday at a public meeting in Detroit.

If this does not work, Detroit will almost certainly have to declare bankruptcy.  If that happens, it will be the largest municipal bankruptcy in U.S. history.

#4 On Friday it was announced that the unemployment rate in Italy had risen to 11.7 percent.  That was a huge jump from 11.3 percent the previous month, and Italy now has the highest unemployment rate that it has experienced in 21 years.

#5 The youth unemployment rate in Italy has risen to a new all-time record high of 38.7 percent.

#6 On Friday it was announced that the unemployment rate in the eurozone as a whole had just hit a brand new record high of 11.9 percent.

#7 On Friday it was announced that the unemployment rate in Greece has now reached 27 percent, and it is being projected that it will reach30 percent by the end of the year.

#8 The youth unemployment rate in Greece is now an almost unbelievable 59.4 percent.

#9 On Saturday, hundreds of thousands of protesters filled the streets of Lisbon and other Portuguese cities to protest the austerity measures that are being imposed upon them.  It was reportedly the largest protest in the history of Portugal.

#10 According to Goldman Sachs, bank deposits declined all over Europe during the month of January.

#11 Over the weekend, the deputy governor of China’s central bank declared that China is prepared for a “currency war“…

A top Chinese banker said Beijing is “fully prepared” for a currency war as he urged the world to abide by a consensus reached by the G20 to avert confrontation, state media reported on Saturday.

Yi Gang, deputy governor of China’s central bank, issued the call after G20 finance ministers last month moved to calm fears of a looming war on the currency markets at a meeting in Moscow.

Those fears have largely been fuelled by the recent steep decline in the Japanese yen, which critics have accused Tokyo of manipulating to give its manufacturers a competitive edge in key export markets over Asian rivals.

#12 Italy is an economic basket case at this point, and the political gridlock in Italy is certainly not helping matters.  Former comedian Beppe Grillo’s party could potentially tip the balance of power one way or the other in Italy, and over the weekend he made some comments that are really shaking things up over in Europe.  For one thing, he is suggesting that Italy should hold a referendum on the euro…

“I am a strong advocate of Europe. I am in favor of an online referendum on the euro,” Beppe Grillo told Bild am Sonntag.

Such a vote would not be legally binding in Italy, where referendums can only be used to repeal laws or parts of laws, but would carry political weight. Grillo has said in the past that membership of the euro should be up to the Italian people.

In addition, Grillo is also suggesting that Italy’s debt has gotten so large that renegotiation is the only option…

In an interview with a German magazine published on Saturday, Mr Grillo said that “if conditions do not change” Italy “will want” to leave the euro and return to its former national currency.

The 64-year-old comic-turned-political activist also said Italy needs to renegotiate its €2 trillion debt.

At 127 per cent of gross domestic product (GDP), it is the highest in the euro zone after Greece.

“Right now we are being crushed, not by the euro, but by our debt. When the interest payments reach €100 billion a year, we’re dead. There’s no alternative,” he told Focus, a weekly news magazine.

He said Italy was in such dire economic straits that “in six months, we will no longer be able to pay pensions and the wages of public employees.”

And of course government debt has taken center stage in the United States as well.

The sequester cuts have now gone into effect, and they will definitely have an effect on the U.S. economy.  Of course that effect will not be nearly as dramatic as many Democrats are suggesting, but without a doubt those cuts will cause the U.S. economy to slow down a bit.

So what comes next?

Well, everyone should keep watching Europe very closely, and it will also be important to keep an eye on Wall Street.  There are a whole bunch of indications that the stock market is at or near a peak.  For example, just check out what one prominent stock market analyst recently had to say

“Every reliable technical tool is warning of major peaking action,” said Walter Zimmerman, the senior technical analyst at United-ICAP. “This includes sentiment, momentum, classical chart patterns, and Elliott wave analysis.

“Most of the rally in the stock market since 2009 can be chalked up to the Federal Reserve’s attempt to create a ‘wealth effect’ through higher stock market prices. This only exacerbates the downside risk. Why? The stock market no is longer a lead indicator for the economy. It is instead reflecting  Fed manipulation. Pushing the stock market higher while the real economy languishes has resulted in another bubble.

“The next leg down will not be a partial correction of the advance since the 2009 lows. It will be another major financial crisis. The worst is yet to come.”

Sadly, most people will continue to deny that anything is wrong until it is far too late.

Many areas of Europe are already experiencing economic depression, and it is only a matter of time before the U.S. follows suit.

Is US Concealed Carry in Jeopardy?

John Adams, Thomas Jefferson, James Madison, Alexander Hamilton and  Zacharia Johnson would be surprised and amazed by the shenanigans being perpetrated against our 2nd Amendment Rights.

Prior to the 1897 supreme court case Robertson v. Baldwin, the federal courts had been silent on the issue of concealed carry. In the dicta from a maritime law case the Supreme Court commented that state laws restricting concealed weapons do not infringe upon the right to bear arms protected by the Federal Second Amendment.[58]

In the majority decision in the 2008 Supreme Court case of District of Columbia v. Heller, Justice Antonin Scalia wrote;

“Like most rights, the Second Amendment right is not unlimited. It is not a right to keep and carry any weapon whatsoever in any manner whatsoever and for whatever purpose: For example, concealed weapons prohibitions have been upheld under the Amendment or state analogues … The majority of the 19th-century courts to consider the question held that prohibitions on carrying concealed weapons were lawful under the Second Amendment or state analogues.”[59]

Heller was a landmark case because for the first time in United States history a Supreme Court decision defined the right to bear arms as constitutionally guaranteed to private citizens rather than a right restricted to “well regulated militia[s]“. The Justices asserted that sensible restrictions on the right to bear arms are constitutional however an outright ban on a specific type of firearm, in this case handguns, was in fact unconstitutional. The decision is limited because it only applies to federal enclaves such as the District of Columbia.

On June 28, 2010, the U.S. Supreme Court struck down the handgun ban enacted by the city of Chicago, Illinois, in McDonald v. Chicago, effectively extending the Heller decision to states and local governments nationwide.[60] Banning handguns in any jurisdiction has the effect of rendering invalid any licensed individual’s right to carry concealed in that area except for federally exempted retired and current law enforcement officers and other government employees acting in the discharge of their official duties.

In a sweeping ruling on a Colorado case, the Tenth U.S. Circuit Court of Appeals decreed that there is no Second Amendment right to carry a concealed firearm in public. The broad wording of the decision in Peterson v. Martinez creates a far-reaching national precedent against carrying a loaded handgun outside the home.

consequently, one can be fairly certain that this case will make its way to the Supreme court. A court that in 2008 created the legal fiat that “Like most rights, the Second Amendment right is not unlimited.”

Should we be worried about a Supreme Court Decision? You betcha!

Remember what happened with ObamaCare! We can’t always trust the courts anymore because they have been packed with incompetent, unprincipled ideologues that can be easily manipulated  When the Progressives can’t get their way with legislation, they use the courts to bypass the will of the people.

Less than a month after his approval by the City Council, McCarthy attended a service at St. Sabina’s Church (a parish led by anti-gun extremist Father Michael Pfleger) and made a speech claiming that a lack of restrictive gun control laws is “government sponsored racism.”

Those with a better understanding of history will find themselves confused trying to interpret McCarthy’s logic, as decades of scholarship have proven just the opposite; that gun control, rather than its absence, has often been used as a means of government sponsored racism.

In his 1995 Kansas Journal of Law & Public Policy article, “The Racist Roots of Gun Control,” Second Amendment scholar Clayton E. Cramer outlines the historical case that “racism underlies gun control laws.” Cramer notes that racist gun control in America stretches as far back as 1751 with a French law in the Louisiana territory that required colonists to “‘[i]f necessary,’ beat ‘any black carrying any potential weapon, such as a cane.’”

Though Superintendent McCarthy might be excused for not looking that far back, he should certainly be aware of last year’s U.S. Supreme Court opinion in the case of McDonald v. Chicago.  In a concurring opinion in that case, Justice Clarence Thomas explained that in the years preceding the Civil War, “Many legislatures amended their laws prohibiting slaves from carrying firearms to apply the prohibition to free blacks as well.” After the Civil War, little improved.  Justice Thomas writes: “Some States formally prohibited blacks from possessing firearms… Others enacted legislation prohibiting blacks from carrying firearms without a license, a restriction not imposed on whites.”

Other Reconstruction Era (and later) laws were less candid. For example, an 1870 Tennessee law barred the sale of all but the most expensive pistols, effectively disarming newly freed blacks and the poor.  New York’s Sullivan Law of 1911, requiring a permit for handgun possession, was largely targeted at Italians and other disfavored immigrant groups. (That law is still on the books.)  And the Rev. Martin Luther King Jr. was denied a concealed carry permit in Alabama under a similar discretionary permitting law—even after his house had been bombed.

We suggest that in the future, Superintendent McCarthy might do a little more research before conflating respect for a fundamental individual right with its antithesis, government-sponsored racism.

BOSTON —  As lawmakers cast around for ways to curb gun-related violence, some are hoping the insurance market might offer incentives.

A bill filed Friday in Massachusetts would require gun owners to purchase liability insurance in the event that a firearm is used to injure.

The insurance policies would give those injured by a weapon a legal recourse, backers of the bill say, but they also would create financial incentives that could reduce accidents and fatalities. Gun owners, for example, might see lower insurance rates if they agreed to take firearms training courses and properly stored their weapons.

“Insurance companies were able to discourage smoking through the marketplace and make cars safer through the marketplace,” said state Rep. David Linsky, the bill’s sponsor.

And insurers have more leeway than law enforcement in some cases, he said.

Massachusetts already has gun storage laws, but police cannot come into a person’s home without a warrant, Linsky pointed out. An insurance company, however, would be able to verify that there is proper gun storage before writing a policy.

Officials at the National Conference of State Legislatures say that, to their knowledge, no state has adopted a gun insurance requirement.

The idea is already meeting with resistance from gun rights advocates, who say it amounts to more regulation aimed at law-abiding gun owners.

“Now we’re going to have insurance companies telling us how we are supposed to be trained and where we are going to store our guns?” said Jim Wallace, executive director of the Gun Owners Action League in Massachusetts.

Craig Baenziger, who works at a gun- and ammunition-seller in North Attleboro called Northeast Trading Co., said requiring liability insurance for guns makes little sense because it targets people who buy the weapons legally instead of going after criminals who illegally possess them.

“Insurance on your gun isn’t really going to decrease crime or accidents. Nobody shoots their friend on purpose. It’s not going to do anything,” Baenziger said. “It’s just a way to increase revenue for the state.”

But supporters say requiring liability insurance could cut down on accidents, because gun owners who store their weapons safely would pay less for their insurance. It could also curb the flow of illegal guns because insurance policies would reward owners who secure weapons against theft.

Other recent gun-control proposals being pushed in the wake of the shootings at the Sandy Hook Elementary School in Newtown, Conn., have focused more directly on banning the sale or possession of certain weapons.

President Barack Obama is pushing a series of steps including requiring background checks on all gun sales, reinstating the ban on guns classified as assault weapons and renewing a 10-round limit on the size of ammunition magazines.

GOOD NEWS: MAYOR BLOOMBERG’S JOURNALIST REPELLENT SYSTEM IS WORKING PERFECTLY

My old friend Jason Mattera, now with the Andrea Tantaros show, participated in a stress test of New York mayor Michael Bloomberg’s journalist repellent systems, and I’m pleased to report that the system is functioning beautifully.  The Mayor is protected from a number of things he would prefer his citizens remain vulnerable to, including impertinent questions.  He doesn’t seem any more eager to declare his own personal “gun-free zone” than most other gun control zealots, but he’s strongly in favor of journalism-free zones:

You can tell Jason is mellowing out, because in his wild youth he would have done the interview with a Big Gulp in his hand.  If he gets a chance to conduct a follow-up interview, I’m hoping he’ll ask if Bloomberg has ever participated in Barack Obama’s “frequent skeet shoots,” which I believe look something like this:

It’s remarkable how reliably the “why won’t you disarm your bodyguards?” question discombobulates the anti-Second Amendment crowd.  They really don’t have a comfortable focus-group-friendly answer to it.  The coldly logical responses – “because I’m more important than you, so I need protection” – simply do not sit well with the public.  That includes people who might otherwise be content to ride in the gun-control bandwagon, until they hit this particular intellectual speed bump.

The question is not, “Why should you have a professional security detail while I must defend myself?”  If that were the issue at hand, it wouldn’t be tough to answer the question.  Instead, the ruling class finds it difficult to explain why they should enjoy armed protection while the rest of us are forbidden to defend ourselves at all, or must do so within an environment of complex restrictions that put us at a pronounced disadvantage against attackers.  This position might be easier to defend if the Little People faced no significant risk of criminal attack, but that’s obviously not the case.  It’s especially obvious if you know more about the recent history of law-abiding citizens defending themselves with firearms than the national media wants you to know.

Serious students of American liberty read the Second Amendment and see the right of individual citizens to defend themselves, and their families, against tyranny and barbarism.  It is increasingly offensive to hear people with armed security details lecture us on how it’s really more like a provisional license to shoot ducks and clay pigeons.

Update: You’ll have to make do with the artistic representation of Obama’s frequent skeet shooting sessions provided by Messrs. Brooks and Korman, because the White House refuses to provide photos of our gun-slinging President filling the sky with hot lead.

Congressional Democrats introduced a new and broader assault-weapons ban  Thursday, in a vivid press conference that included a display of various weapons  they want to outlaw.

It was a measure that was quickly condemned by the National Rifle Association  as an assault on the Constitution, “instead of prosecuting criminals or fixing  our broken mental health system.”

“The American people know gun bans do not work and we are confident Congress  will reject Senator Feinstein’s wrong-headed approach,” spokeswoman Andrew  Arulanandam said.

The measure was written by Democratic Sen. Dianne Feinstein, who was behind  the original 1994 assault-weapons ban which expired in 2004. It marks the first  major legislative step since President Obama, in the wake of the Newtown school  shooting, called for new gun control measures including a new and stronger  assault-weapons ban.

“Our weak gun laws allow these mass killings to be carried out again, and  again, and again in our country,” Feinstein said. “Weapons, designed originally  for the military to kill large numbers of people in close combat, are replicated  for civilian use.”

She said the bill she and her colleagues are introducing would bar the “sale,  transfer, manufacture and importation” of assault weapons. It would also ban  magazines that hold more than 10 rounds.

As part of the press conference, lawmakers displayed an array of weapons,  including a Colt AR-15, a semi-automatic assault rifle, and an Intratec TEC-9, a  semi-automatic handgun.

The move comes after NBC News host David Gregory faced an investigation for  displaying a banned magazine on a Sunday show in the District — but the Senate  sergeant-at-arms office said the weapons were displayed Thursday in “compliance”  with all applicable laws.

The office said they are “authentic” and in the custody of the Philadelphia  and D.C. police departments, which brought them.

The weapons ban, though, faces long odds even after last month’s mass school  shooting in the state of Connecticut.

In a statement, Republican Texas Sen. Ted Cruz said the proposal would have  done “nothing” to prevent the Newtown tragedy and vowed to fight to defeat the  bill.

“Washington politicians shouldn’t be taking advantage of recent tragedy to  try to push an aggressive gun control agenda. Real assault weapons — machine  guns — are already functionally illegal, and they have been since 1934,” he  said.

The last ban expired in 2004 when Congress refused to renew it under pressure  from the National Rifle Association, a gun advocacy group. There’s continuing  disagreement about the effectiveness of the original assault-weapons ban, and  measures like beefed-up background checks on gun sales may be more likely to  pass.

Definitions of what qualifies as an assault weapon have varied over time and  across states.

According to a summary from Feinstein’s office, her bill would place bans on  120 “specifically named firearms,” as well as certain other semiautomatic guns  — and those with a fixed magazine that can hold more than 10 rounds.

While the 1994 law defined an assault weapon as one that had, in most cases,  a detachable magazine and at least two characteristics as set by Congress, the  new bill would define an assault weapon as one that meets just one of those  characteristics.

Some of those characteristics for rifles in the old law included a pistol  grip, a folding stock and a bayonet mount. But the Feinstein bill would strip  what her office describes as “easy-to-remove” characteristics like the bayonet  mount from that list.

Feinstein’s office says the bill would grandfather in weapons legally owned  before enactment and exempt more than 900 “specifically named weapons” for  hunting or sporting purposes.

President Obama says he plans to make public later this week the  details of his plan to tighten firearms laws based on the findings of a  White House task force he commissioned in the aftermath of the fatal Connecticut  school shooting.

The task force was led by Vice President Joe Biden and held its final White  House meeting Monday, talking with members of the House Democratic Gun Violence  Prevention Task Force.

A source told Fox News that Biden explained at the meeting that he and his  staff have researched various plans of action to reduce and prevent gun violence  and have identified 19 different options the president could choose to implement  through executive order.

Obama said Monday he planned to review the findings and will “vigorously  pursue” the recommendations in the next few days. It’s unclear how many of the  19 options the president would eventually take up.

The president vowed after the Dec. 14 massacre at Sandy Hook Elementary  School in Newtown, Conn., that he would look for ways to curb gun violence,  including possible legislation to ban assault weapons and high-capacity  ammunition clips like those used in the attack, which killed 20 first-graders  and six adults at the school.

Among the other potential proposals is tightening background checks on  prospective gun buyers. The president said Monday some of his goals could be  accomplished through legislation, while others could be done through executive  action.

The White House meeting Monday included Attorney General Eric Holder,  Homeland Security Secretary Janet Napolitano and Health and Human Services  Secretary Kathleen Sebelius, who have participated in several other talks.

“Our task force looks forward to working with … the Obama administration  and all stakeholders to enact a comprehensive set of proposals that  both respects the 2nd Amendment rights of law-abiding citizens without a history  of dangerous mental illness and helps keep our schools, streets and communities  safe from gun violence,” said California Rep. Mike Thompson, chairman of the  eight-member House task force.

Biden already has talked with individuals and groups supporting tougher guns  laws, including the Brady Campaign, and gun rights groups, including the  National Rifle Association, which opposes any legislation to again ban assault  weapons and high-capacity clips. Biden also has spoken with governors and  executives with the video-gaming industry.

Obama has suggested he will submit legislation after his Jan. 21 inauguration  and Congress’ return to Washington.

California already has the most restrictive gun laws in the nation. Buying a  handgun requires registration, a safety certificate, a 10-day waiting period and  a rigorous background check. All direct person-to-person sales are banned and  concealed-carry permits are rare.

But now, in the wake of the Newtown tragedy, lawmakers in the Golden State  have launched into a new legislative frenzy to restrict firearms further. And  they’re confident the measures will pass, given Democrats have a two-thirds  “super majority” in both chambers — which means they have the power to pass  legislation and get constitutional amendments on the ballot without a single  Republican vote.

Political analysts say the political landscape puts California in the pole  position to test gun-control limits.

“Almost any idea that anybody in this country has, as to further regulate and  limit access to weapons or ammunition, is probably going to get passed in  California,” said Democratic strategist and USC law professor Susan  Estrich.

Gun Control44Law enforcement officials from a New York region where a local paper  published a map identifying gun owners say prisoners are using the information  to intimidate guards.

Rockland County Sheriff Louis Falco, who spoke at a news conference flanked  by other county officials, said the Journal News’ decision to post an online map  of names and addresses of handgun owners Dec. 23 has put law enforcement  officers in danger.

“They have inmates coming up to them and telling them exactly where they  live. That’s not acceptable to me,” Falco said, according to Newsday.

Robert Riley, an officer with the White Plains Police Department and  president of its Patrolman’s Benevolent Association, agreed.

“You have guys who work in New York City who live up here. Now their names  and addresses are out there, too,” he said adding that there are 8,000 active  and retired NYPD officers currently living in Rockland County.

Local lawmakers also say that they intend to introduce legislation that  prevents information about legal gun owners from being released to the  public.

The newspaper published the online map last month alongside an article  titled, “The gun owner next door: What you don’t know about the weapons in your  neighborhood.” The map included the names and addresses of pistol permit holders  in Westchester and Rockland counties obtained through a Freedom of Information  Act request.

While the paper ostensibly sought to make a point about gun proliferation in  the wake of the school shooting in Newtown, Conn., the effort may have  backfired. A blogger reacted with a map showing where key editorial staffers  live, and some outraged groups have called for a boycott of parent company  Gannett’s national advertisers. Ironically, the newspaper has now stationed  armed guards outside at least one of its offices.

WILL BANNING GUNS STOP HOMICIDES? STATS FROM ENGLAND AND AUSTRALIA SHOW…

The debate on gun control is only gaining momentum. On Thursday, Senator Diane Feinstein outlined her plans to introduce sweeping legislation that includes fingerprinting and registration of all those who currently own so-called semi-automatic “assault” weapons.

Those in favor of a total ban on firearms often point to countries like England and Australia where firearms are banned or virtually impossible to possess. A look into the statistics might offer some clarity, though, about how safe such a move actually makes a country.

Let’s start at home. From 2009 to 2011, homicides overall declined slightly according to a 2011 Centers for Disease Control (CDC) report, with a corresponding drop in homicides by firearms.

In fact, the report says homicide is not among the top 15 leading causes of death in America. (As recently as 2009, the CDC reported that homicide was in the top 15 at #15.) Instead:

  • Accidents (unintentional deaths) were #5 and Suicide (intentional harm) has held solid as the 10th leading cause of death for several years.
  • The stats from 2009 show that homicides totaled 16,799, with 11,493 of those attributed to guns.
  • During that same year, motor vehicle deaths were nearly triple that of gun-related deaths — 34,485 vs. 11,493.
  • Death from accidental falls totaled 24,792, almost double the firearms homicide total.

The stats for gun deaths have actually shown some significant declines in the past two decades.

Looking at the above graph, it is worth noting that deaths caused by “other guns” has been relatively flat since 1985. The assault weapons ban was in place from 1994-2004.

And what about the argument most often made by the Left quoting the success of oppressive gun laws in countries like Australia and England? A recent opinion piece in the Wall Street Journal by Joyce Lee Malcolm shows that argument to be hollow: “After a school massacre, the U.K. banned handguns in 1998. A decade later, handgun crime has doubled.”

Malcom’s article details what happened after Australia banned many guns following a 1996 mass murder of 35 people by a madman with assault rifles. The country tightened registration laws, banned assault rifles, pump-action shotguns, and also forced a buy back of more than 600,000 guns. What effect did this have on crime?

“A 2003 study published by the Brookings Institution, found homicides “continued a modest decline” since 1997. They concluded that the impact of the National Firearms Agreement was “relatively small,” with the daily rate of firearms homicides declining 3.2%.”

During the same period in America, deaths attributed to firearms dropped by nearly ten times the decline seen in Australia. Restricting or confiscating handguns seems to have had almost no effect on homicides in Australia and the stats also show that the law had no real effect on suicides.

“Suicides with firearms went down but suicides by other means went up,” Malcom notes.

And what about the oft-cited British gun laws? Have they done the job?

Restrictive gun laws have been around for almost 100 years in England, and Malcolm reports that getting a permit requires proving to police that you have a “good reason” for needing a gun. Self defense is not considered to be a good reason in England. Following a 1987 shooting in the British town of Hungerford, the Brits enacted stricter controls. And in 1998, a near-total ban on gun ownership followed another mass shooting. Were these moves a success?

Within a decade of the handgun ban and the confiscation of handguns from registered owners, crime with handguns had doubled according to British government crime reports. Gun crime, not a serious problem in the past, now is. Armed street gangs have some British police carrying guns for the first time.

There is little doubt that the Senate will soon put forth new legislation regarding gun ownership, especially as it relates to so-called assault weapons. However, those making the argument that banning guns has worked in places like Australia and England might be advised to check the statistics or risk looking foolish if they encounter someone armed with the facts.

“No set of laws can eliminate evil from the world, or prevent every senseless act of violence in our society.”

So said President Obama in words of comfort in Newtown. The president was right to speak of evil, but mistaken when he called the massacre “senseless.”

For this was a premeditated and purposeful act of mass murder, and the devil that did it knew exactly what he was doing and why.

When he put four bullets into his mother’s head while she lay in bed, Adam Lanza wanted her life ended along with his. When he headed for Sandy Hook Elementary, with the Glocks and Bushmaster rifle, he knew he would encounter no armed resistance.

Before he went into that school to shoot 20, 30 or 40 children, barely more than babies, he knew his slaughter would be so stomach-turning and heart-wrenching that the TV crews would come running.

And by day’s end, the world would know who Adam Lanza was.

Lanza kept firing at the children until he heard the sirens. Then he pulled out one of the Glocks, put it to his head and ended it, knowing he was on his way to becoming world famous.

Just as Eric Harris and Dylan Klebold of Columbine are famous. Just as James Holmes, the “Joker” of the Aurora “Dark Knight Rising” massacre, is famous. Just as Jared Lee Loughner, the Tucson mass murderer who shot Gabby Giffords, is famous.

A desire to be famous coupled with a dead conscience is the common thread running through these recurring atrocities. These loners and losers want us to know who they are. And, to succeed now, each almost has to outdo in horror those who went before.

Since the news first came in Friday from Newtown, we have argued about guns in America and mental illness, but heard little about the moral sickness of our society.

Americans have always owned guns. But in Prohibition, when gangsters like John Dillinger, “Machine Gun” Kelly and “Baby Face” Nelson were notorious, the most remembered atrocity was the “St. Valentine’s Day Massacre.” Al Capone’s gang executed seven of Bugs Moran’s gang in a Chicago garage.

Yet, just two years ago, when one Washington, D.C., drive-by shooting ended with four dead on a sidewalk and five wounded, it was just local news.

Why are these atrocities growing more frequent and deadly?

We are told that it is because the guns used – especially assault rifles like Russian-made AK-47s and civilian copies of the M-16 used in Vietnam, like the Bushmaster – are all too available.

But the guns used in the Sandy Hook massacre were legally purchased by Lanza’s mother, and she and Adam lived in a state with some of the strictest gun laws in the country.

And the Bushmaster is not a machine gun but a semi-automatic, as are the 100-year-old Colt .45 and M-1 rifle used by GIs in World War II. Fully automatic weapons like the Thompson submachine gun cannot be purchased without a federal license. No fully automatic weapon has been used in any of these massacres.

Will ending all sales and transfers of assault rifles and limiting the rounds in clips and magazines reduce these massacres in malls, movie theaters and schools? Did it succeed when the assault weapons ban was in force in the Clinton years?

If assault rifles are evil things that ought not be in the hands of decent Americans, why do “shoot-to-kill” video games feature these weapons?

Why does Hollywood glamorize assault rifles in action-packed films of slaughter starring Bruce Willis, Sylvester Stallone, Arnold Schwarzenegger, Chuck Norris and Jason Statham?

Few of America’s young have seen an assault weapon fired outside the military. Scores of millions have seen them fired on TV. Many of our movies are advertisements for the efficiency of assault weapons in the hands of good guys doing heroic deeds.

Are the folks who think America would be a better place with a more restrictive Second Amendment willing to restrict the First Amendment to stop all distribution of movies and cable shows that depict famous actors blasting enemies with assault weapons?

Not long ago, there existed in our hearts “a fear of God.”

How, we would ask ourselves, if we commit an evil act like murder, will we answer at God’s judgment seat? For He will decide if we enter what the president called in Newtown, God’s “eternal house in heaven.”

But if God is dead, not to worry. Just put the gun to your head and pull the trigger, and it’s over. No trial. No disgrace. No prison. Nothing to worry about anymore.

No voice of conscience told Adam: Do not do this evil thing! Now he is no longer a nobody, a nerd, a recluse. He is famous. Everybody is talking about him, and ruminating on what might have motivated him.

Adam wanted to be somebody. And now he is.

And out there others like him are thinking: That could be me.

Exclusive: Security officials on the ground in Libya challenge CIA account

Despite a carefully narrated version of events rolled out late this week by the CIA claiming agents jumped into action as soon as they were notified of calls for help in Benghazi, security officials on the ground say calls for help went out considerably earlier — and signs of an attack were mounting even before that.   The accounts, from foreign and American security officials in and around Benghazi at the time of the attack, indicate there was in fact a significant lag between when the threat started to show itself and help started to arrive.   According to the CIA, the first calls for assistance came at 9:40 p.m. local time from a senior State Department official at the U.S. Consulate in Benghazi, to the CIA annex about a mile away.   But according to multiple people on the ground that night, the Blue Mountain Security manager, who was in charge of the local force hired to guard the consulate perimeter, made calls on both two-way radios and cell phones to colleagues in Benghazi warning of problems at least an hour earlier. Those calls allegedly went to local security contractors who say that the CIA annex was also notified much earlier than 9:40 p.m. U.S. military intelligence also told Fox News that armed militia was gathering up to three hours before the attack began.   One source said the Blue Mountain Security chief seemed “distraught” and said “the situation here is very serious, we have a problem.” He also said that even without these phone and radio calls, it was clear to everyone in the security community on the ground in Benghazi much earlier than 9:40 p.m. that fighters were gathering in preparation for an attack.   Many of these security contractors and intelligence sources on the ground in Benghazi met twice a week for informal meetings at the consulate with Blue Mountain and consulate staff, and at times other international officials. They were all very familiar with security at the consulate — and said the staff seemed “complacent” and “didn’t seem to follow the normal American way of securing a facility.”   Both American and British sources say multiple roadblocks set up by fighters believed to be with Ansar al-Sharia were in place in Benghazi several hours before the 9:40 p.m. timeline and that communications also alluded to “heavily armed troops showing up with artillery.” Fox News was told by both American and British contacts who were in Benghazi that night that the CIA timeline rolled out this past week is only “loosely based on the truth” and “doesn’t quite add up.”   Fox News was also told that the local guard force meant to protect the consulate perimeter “panicked” and didn’t know what to do as the attackers took up positions. Sources say other guards simply “walked away”.      One former Special Op now employed by a private company in Benghazi said that even the safe room wasn’t properly set up. He said “the safe room is one of the first measures you take” and that he is “not sure how you can set a safe room without fire suppression and ventilation in case of fire.” He also said, “Ambassador Stevens would likely be alive today if this simple and normal procedure was put into place.”   As details emerge of serious security issues before the attack on Sept. 11, Fox News is also beginning to hear more frustration from sources both on the ground in Benghazi and in the U.S. Multiple British and American sources insist there were other capabilities in the region and are mystified why none were used. Fox News was told there were not only armed drones that monitor Libyan chemical weapon sites in the area, but also F-18′s, AC-130 aircraft and even helicopters that could have been dispatched in a timely fashion.      British intelligence sources said that unarmed drones routinely flew over Benghazi every night in flight patterns and that armed drones which fly over chemical sites, some a short flight from Benghazi, “were always said to be on call.” American sources confirmed this and questioned “why was a drone armed only with a camera dispatched?”   Another source added, “Why would they put a ragtag team together in Tripoli as first responders? This is not even what they do for a living. We had a first responder air base in Italy almost the same distance away.” Despite the team arriving from Tripoli that night, sources said sufficient American back-up never came.   British sources on the ground in Benghazi said they are extremely frustrated by the attack and are still wondering why they weren’t called for help. “We have more people on the ground here than the Americans and I just don’t know why we didn’t get the call?” one said.   Both American and British sources said, at the very least, the security situation on the ground and the lack of proper response were the result of “complete incompetence.” The covert team that came in from Tripoli was held up at the Benghazi airport for more than three hours by Libyan officials. Sources said the team notified officials in Washington that they were being delayed within 30 minutes of their arrival.   They also point out that these questions “don’t even address the military capabilities of our United Nations ally Turkey, who (has) forces available a similarly short flight away.” Fox News has learned that Turkey had a number of embassy staff in town the night of the attack and that the Turkish consul general met with Ambassador Stevens in Benghazi the night he and the three other Americans were killed.   One source asked, “Were the Turks not warned? What forces were available from our ally Turkey? Especially since they had officials there in Benghazi also and had to be concerned … and where was the U.N. in all of this?”   Fox News’ Jennifer Griffin contributed to this report
